The Mince Pie Project 2013: Terms & Conditions

Definitions

In these terms and conditions the following words and phrases shall have the following meanings (and, where applicable in these terms and conditions, the singular shall include the plural):

  • “Auction”: The auction run by The Mince Pie Project during the Term
  • “Auction Terms and Conditions”: These terms and conditions relating to the Auction
  • “Bid Period”: The period, during which a Participant may bid for a particular item in an Auction
  • “Raffle”: The raffle run by The Mince Pie Project during the Term
  • “Raffle Terms and Conditions”: These terms and conditions relating to the Raffle
  • “Raffle Period”: The period, during which a Participant may purchase tickets in a particular Raffle
  • “Term”: The period of time that the auction and the raffle are active, between Friday 6th December to Friday 13th December inclusive
  • “The Mince Pie Project”: The Mince Pie Project is an unincorporated charitable association of 14 Victoria Park Square, London, E29PB
  • “Participant” or “you”: A person who participates in the Auction or Raffle
  • “Website”: themincepieproject.com

Introduction

The Mince Pie Project is an unincorporated charitable association, registered address 14 Victoria Park Square, London, E29PB , HMRC Charities reference number EW06257

The Mince Pie Projects objectives are: ‘To work towards the prevention or relief of child poverty in the UK by providing grants to charities, or other organisations, working to prevent or relieve child poverty, with funds raised through a Christmas charity mince pie auction’

FoodCycle and Kids Company have been selected as beneficiary charities for the 2013 auction and raffle, and will be rewarded grants of equal amounts upon completion of the Raffle Period, and Auction Period

  1. Kids Company is a UK Registered Charity (Registered Charity No. 1068298) based in Kids Company, 1 Kenbury Street, London, SE5 9BS This charity provides practical, emotional and educational support to vulnerable inner-city children. Their services reach 36,000 and intensively support 18,000 children, young people and vulnerable adults across London and Bristol, including the most deprived and at risk whose parents are unable to care for them due to their own practical and emotional challenges.

  2. FoodCycle is a UK Registered Charity (Registered Charity No. 1134423) and builds communities by combining volunteers, surplus food and spare kitchen space to create nutritious meals for people at risk of food poverty and social isolation. Over 400,000 tonnes of edible food is wasted each year yet over 4 million people are affected by food poverty across the UK. Since FoodCycle started cooking in May 2009, their network of 1,200 volunteers have served over 80,000 meals for people in need.

We are working with both charities this Christmas to raise a minimum £30,000 for their work, hopefully a lot more.

Auction Terms and Conditions

All auctions will take place between midday Friday 6th December 2013 and midday Friday 13th December 2013

During the Bid Period each Participant must go online to themincepieproject.com from where they’ll be redirected to eBay to place their bid

A valid and active eBay account is required in order to place a bid The auctions will be run according to the terms and conditions of eBay. Where a bid is successful, the Participant will be contacted by The Mince Pie Project and eBay

Full details of all auctions will be available on the Website including any specific terms & conditions for each lot

Bids for an Auction item will only be taken during the Bid Period. The successful Participant will be contacted by The Mince Pie Project and eBay

Participants must be 18 years of age or over. We reserve the right to verify the eligibility of all entrants

Payment for an item must be transferred through Paypal or debit or credit card or bank transfer.

The amount to be paid, having been deducted from or charged to the Participant’s debit or credit card, shall constitute consideration. All Participants must ensure that, prior to placing a bid, they are able to pay for any item which they wish to bid for

All matters relating to the Auction shall be at our sole discretion.

Notwithstanding that a successful bid has been received, in the event that we discover that (i) the Participant was or should have been ineligible to make a bid for an item, or (ii) that the

Participant should have been declared invalid for any other reason whatever (at our absolute discretion), we reserve the right to reject the bid. In such circumstances, we reserve the right to offer the prize to the second highest bidder.

Raffle Terms and Conditions

All raffles are operated as small societies lotteries, and registered with Tower Hamlets County Council, in accordance with the requirements of the Gambling Act 2005

The Raffle is open to all Great Britain residents over the age of 16. Any person found to be under the age of 16 automatically forfeits the right to any prize.

Participation in each Raffle costs £2 per ticket and all ticket purchases are non-refundable

Tickets for each Raffle will be able to be purchased between midday Friday 6th December 2013 and 2pmFriday 13th December 2013.

Any entries received after this will forfeit the right to any prizes and treated as a donation to the charity

An email will be sent to each Participant confirming their ticket numbers in the draw and thanking them for their participation

All online ticket purchases will be managed by our payment processor, Stripe. They will deduct a 2.4% fee plus 20p per transaction to cover their admin costs

All draws will be made on 14th December 2013 and will be made in the presence of two witnesses

The prize for each Raffle is a box of 35 mince pies from the specified chef

All Winners will be notified in writing on 14th December, to the email submitted when purchasing

Raffle tickets

A list of winning Participants will be available from The Mince Pie Project on receipt of a stamped addressed envelope

Gambling can be great fun, but it’s also important to know when to stop and what the danger signs are. Delivery

Prizes will be available for collection from the specified chef, at the postcode specified on the website, at 9am on Wednesday 18th December

The Mince Pie Project can alternatively arrange delivery of mince pies, in coordination with CitySprint, at a cost of £5 within 20 miles, and 75p per mile thereafter

All delivery payments must be paid in advance of delivery taking place

When an item is delivered, risk of damage to, or loss of, the item passes shall pass to the relevant Participant

Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations under these terms that is caused by events outside our reasonable control (“Force Majeure Event”).

Our performance under these terms is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period.

Returns

You are responsible for inspecting any items at the time of delivery to ensure that they match the items described on the Website.

We will only accept return of the items if it can be shown that the description on the Website was substantially different from that delivered.

In limited circumstances, where you are entitled to return an item, it must be returned direct to us within 14 days of delivery/collection. Items are returned at your own cost and risk. The item will remain your responsibility until it is received by us, so we therefore recommend you return the item by recorded delivery.

Limitation of liability

All items offered for Auction shall be subject to availability and we shall not be liable for any claims, expenses, costs and/or any losses (including, but not limited to, loss of profits, indirect, pure economic and consequential losses or otherwise) or any damage (save for death or personal injury arising from negligence) suffered by any Participant

Variations

We may revise the terms of this User Agreement at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our Website.
